Like that itchy sweater your grandma wove you for Christmas, you can’t return Julibe’s work to a store and receive a gift card in exchange.

Since Julibe pours a ridiculous amount of brains, ingenuity, sweat, tears, and late nights into these projects, this section basically explains the “take-no-backsies” rules.

It is a bit long, Julibe knows, but good fences make good neighbors… and clear boundaries make sure Julibe can keep the lights on and focus on building more cool stuff for you!

TL;DR

Custom labor is non-refundable because the time invested cannot be recovered. However, Julibe strictly adheres to the statutory Right of Retraction as required by applicable consumer law.

  • Effective Date: Jan 01, 2015 – Mar 25, 2027
  • Jurisdiction: Bogotá, Colombia Legal System, Law 1480 of 2011 (Consumer Protection), and Applicable Commercial Law

For the purposes of this document, the following definitions shall apply with absolute technical and legal precision:

  • Visitor or User: Denotes any natural person, corporate entity, or automated software agent (including but not limited to crawlers, scrapers, and indexing protocols) that initiates a network connection with the infrastructure or views any assets hosted on the domain.
  • Prospect: Denotes any individual or entity that initiates a formal inquiry, submits a commercial brief, or engages in pre-contractual communications with the specific intent of evaluating professional services.
  • Client: Denotes any individual or entity that has executed a definitive, legally binding Service Agreement and has fulfilled the requisite initial financial obligations as specified in said agreement.
  • Julibe: Refers exclusively to Julián De Salvador, acting as the sole proprietor and independent service provider, who maintains absolute ownership of the digital infrastructure, proprietary methodologies, and all intellectual property associated with the domain julibe.com and brand name Julibe.

The designations “User”, “Visitor”, “Client”, or “You” are utilized within this document to encompass any entity, whether human or algorithmic, that establishes a digital handshake with the server. All interactions are governed by the specific status of the entity at the time of the connection. Julibe is a single individual. 

Professional Services and Custom Development

The right of retraction does not apply to:

  • Services that have already commenced execution with the consumer’s consent.
  • Goods or services created according to the user’s specific requirements (Personalized Goods).
  • Downloadable digital content where execution has begun with the consumer’s prior express consent.

Retainer fees and project deposits are non-refundable once work commences, subject to the statutory retraction window. Julibe offers case-by-case goodwill resolution for unforeseen project roadblocks.

Julibe retains the right to adjust pricing for additional work requested outside the original Statement of Work.

Payment of a milestone signifies client approval. Once an accepted milestone invoice is paid, those funds are classified as revenue for completed intellectual labor.

Project Cancellation and Suspension Liabilities

In the event of project cancellation initiated by the client, Julibe shall retain funds for work already executed or in progress.

The client shall remain financially liable for any unbilled hourly overages or third-party expenses incurred up to the date of cancellation.

In the event of a payment dispute, Julibe retains ownership of incomplete code bases. Julibe is under no obligation to transfer intellectual property until all outstanding termination invoices are paid in full.

If a client wishes to resume a suspended project, a reasonable project reactivation fee may be applied to cover the administrative cost of re-onboarding.

Financial Disputes and Unauthorized Reversals

Digital products are provided “as is”. Due to the nature of downloadable assets, all sales are considered final subject to the exceptions established by the applicable consumer protection laws.

Any attempt to initiate an unauthorized chargeback for delivered services will be treated as a breach of contract. Julibe reserves the right to apply administrative fees to cover the costs required to address the dispute.

Julibe reserves the right to transfer unpaid termination invoices to third-party collection agencies until the balance is satisfied.

Acceptance of this policy

By using Julibe’s Website, the User signifies acceptance of this policy. Continued use following changes will be deemed as your acceptance of those changes.
